The Guidelines
As an employer, it’s inevitable that there will come a time when a complaint, accusation, or rumor of misconduct will arise. These situations call for an internal investigation to gather facts, sort out the details, and reach a reasonable conclusion.
Workplace investigations demonstrate your company’s commitment to a safe workplace and the objective and fair treatment of your employees. When you go about investigations correctly, you can build trust with your team and build a better work environment for all. Not to mention, following a specific process helps ensure compliance with federal and state employment laws and company policies to minimize the risk of liability or legal recourse.
That said, we know it can be intimidating (even terrifying) when you’re faced with a situation you need to investigate. With over 25 years of HR experience, we’ve been in your shoes. We created these guidelines in collaboration with employment lawyers so companies of any size can set up a clear and replicable process to tackle these difficult situations.
This guide takes you through each step of the investigation process from planning the investigation all the way through to making a determination. It also includes interview questions to guide you through difficult conversations, and an Investigation Report Template to help you record the investigative process and outcomes.
